By using Willuny Labs LLC you confirm your acceptance of, and agree to be bound by, these terms and conditions.
This Agreement takes effect on the date on which you first use the Willuny Labs LLC application or purchase any products.
The Willuny Labs LLC Software License facilitates the acquisition of Willuny Labs LLC software through a single purchase, granting users perpetual access to its comprehensive functionalities. Tailored for developers, entrepreneurs, and businesses, Willuny Labs LLC empowers users to build and deploy web applications efficiently.
This license entails a straightforward arrangement, exempting users from recurring fees or subscriptions for one-time purchases. The licensor reserves the right to terminate this license if the user violates these terms and conditions, including but not limited to: unauthorized redistribution, resale, or sharing of the software with third parties.
Due to the nature of digital products, Willuny Labs LLC products including but not limited to source code, templates, and software licenses cannot be refunded or exchanged once access is granted. All sales are final.
For European Union Customers: By completing your purchase, you expressly consent to immediate access to the digital content and acknowledge that you waive your right of withdrawal (14-day cooling-off period) as permitted under EU Consumer Rights Directive 2011/83/EU, Article 16(m). You will be asked to confirm this waiver during the checkout process.
It is not warranted that Willuny Labs LLC will meet your requirements or that its operation will be uninterrupted or error free. All express and implied warranties or conditions not stated in this Agreement (including without limitation, loss of profits, loss or corruption of data, business interruption or loss of contracts), so far as such exclusion or disclaimer is permitted under the applicable law are excluded and expressly disclaimed. This Agreement does not affect your statutory rights.
Willuny Labs LLC does not give any warranty, guarantee or other term as to the quality, fitness for purpose or otherwise of the software. Willuny Labs LLC shall not be liable to you by reason of any representation (unless fraudulent), or any implied warranty, condition or other term, or any duty at common law, for any loss of profit or any indirect, special or consequential loss, damage, costs, expenses or other claims (whether caused by Willuny Labs LLC's negligence or the negligence of its servants or agents or otherwise) which arise out of or in connection with the provision of any goods or services by Willuny Labs LLC.
Willuny Labs LLC shall not be liable or deemed to be in breach of contract by reason of any delay in performing, or failure to perform, any of its obligations if the delay or failure was due to any cause beyond its reasonable control.
Notwithstanding contrary clauses in this Agreement, in the event that Willuny Labs LLC is deemed liable to you for breach of this Agreement, you agree that Willuny Labs LLC's liability is limited to the amount actually paid by you for your services or software. You hereby release Willuny Labs LLC from any and all obligations, liabilities and claims in excess of this limitation.
Willuny Labs LLC is not responsible for what the user does with the user-generated content or any modifications made to the software. Users are solely responsible for ensuring their use of the software complies with all applicable laws and regulations.
As we continue to improve Willuny Labs LLC and expand our offerings, the price may increase. Any promotional discounts are provided to help customers secure the current price without being surprised by future increases.
This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law provisions. Any disputes arising out of or relating to this Agreement shall be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.
